The Outer Continental Shelf Lands Act (OCSLA) is a federal statute that provides for compensation for death or injuries “occurring as the result of operations conducted on the Outer Continental Shelf (OCS) for the purpose of exploring for, developing, removing, or transporting by pipeline the natural resources, or involving rights to the natural resources, of the subsoil and seabed of the OCS.”  The OCS encompasses all submerged lands beyond state territorial waters but within U.S. territorial waters.  The definition includes artificial islands and fixed structures upon the OCS, i.e., fixed oil drilling platforms.  Injuries occurring on fixed oil platforms within state territorial waters are generally governed by state law.

Sometimes helicopters are used to transport workers to and from the drilling rigs and fixed platforms, and, occasionally those helicopters carrying rig and platform workers, contractors, crew members, engineers and other support personnel crash into the Gulf of Mexico causing deaths or serious injuries.  In those instances, we represent the widows, children and parents of the workers killed (as well as workers who are injured) when the helicopters transporting the workers to or from the rigs and platforms crash into the Gulf.

Working on offshore rigs and platforms can be dangerous, particularly when the companies who operate the rigs and fixed platforms ignore established safety rules and place short term corporate profits ahead of workers’ safety. The companies that operate the offshore rigs and platforms are required to build and maintain them in such a manner as to provide as safe a working environment as possible.

After a serious accident occurs, companies frequently try to pressure workers into signing statements saying that either that they were not hurt (even if they really were hurt) or saying that they know nothing about the accident (even if they do). This is exactly what happened after the recent BP Transocean Deepwater Horizon Drilling Rig accident, where offshore rig workers were asked to sign false statements saying that they weren’t hurt, or, that they had no knowledge about the blowout.  Do not allow the company to pressure you into signing a false statement. If  you are asked or pressured by your employer or any other company to sign a false statement, you should refuse to sign and immediately demand the right to consult with an attorney before signing any statement, release, or legal document. Don’t be fooled by the company representatives, who are definitely not looking after your best interests.
